Abstract

The resolution issued by the Supreme Court of Justice of the United States of America, which held that “the forced abduction of a defendant [Humberto Álvarez Machain, a Mexican citizen] does not prevent him from being tried in the United States for violating the criminal law of that country”, caused worldwide consternation and an avalanche of criticism from governments, academic institutions, professional associations and individuals, especially jurists, concerned about the future of the law, because such determination has called it into question. The inability of the Supreme Court to respect the sovereignty and jurisdiction of other countries, and to apply the law by the rule of force, cannot be responded to with a corresponding critical incapacity, but rather with the energetic denunciation of the vices legal aspects of this resolution, as the Mexican government has been doing in all instances.
