Jurisdictional Immunity of the States: Regulatory and Practical Differences between Mexico and the United States

Abstract
International law prescribes a general rule that States enjoy jurisdictional immunity before the courts of other States, subject to certain exceptions. The interpretation of this rule varies among countries, and therefore, different legal criteria arise. This article provides an overview of the rules of international law on the subject, as well as the manner in which Mexico and the United States have incorporated them into their respective legal systems.
